Out-of-Court Conflict Resolution Through Business Mediation
When business conflicts escalate, a lot of money, long-term business relationships and important contracts are quickly at risk. As a mediator, I help you resolve conflicts in a pragmatic and solution-oriented way.
Business mediation offers you an effective alternative to litigation or arbitration. This form of alternative conflict resolution is voluntary, confidential and self-determined. The nature of the conflicts can be complex. Business mediation is suitable for resolving in-house conflicts, disagreements between shareholders as well as for reaching agreements between companies, other organizations or individuals.
In the context of mediation, I work as a neutral moderator to help all parties involved move towards and reach an out-of-court agreement. During the search for a resolution to the conflict, it is my responsibility as the mediator to support and direct the communication of the conflict partners in a solution-oriented manner within the framework of a systematic process.
The goal of this structured approach is a solution that takes into account the views of all sides involved in the conflict. Successful mediation means that you and your conflict partners work together to develop a suitable and sustainable solution to the conflict, that satisfies all sides as much as is possible. This agreement is usually recorded in writing as a final agreement.
The agreement should be reviewed by legal counsel before signing, as it gives the respective parties a legal claim to fulfil the promises made.
Mediation
The benefits of mediation compared to trial are obvious:
The cost
Mediation is less expensive than legal proceedings. Legal fees and, if necessary, court costs of both parties exceed the costs of mediation – particularly in view of possible high monetary claims and the number of judicial instances. As a mediator, I calculate my fees at a fixed hourly rate. Thus, your financial risks with regards to the costs of mediation remain transparent and clearly calculable.
Time factor, self-determination & confidentiality
As opposed to a legal proceeding, you are not bound by outside regulations when mediating. You and your conflict partners remain self-determined and save yourselves an often-gruelling walk through the court instances. In a mediation, you can expect a negotiated result after a few days or weeks at the latest. Mediation is a confidential process. The mediator – bound to professional secrecy – guides the negotiations which will remain strictly confidential whether they lead to an agreement or not.
Preservation of business relationships
With a good mediation there are no losers. The parties get to save face. Unlike with court proceedings at trial, mediation enables the parties to design their own concrete solutions in a pragmatic way. Often long-standing conflicts can be solved, whereby all negotiating partners get back into the conversation, instead of leaving it up to their attorneys. A prerequisite is the willingness of the parties to participate in the mediation process with an open mind and a readiness to compromise.
Conflict Management and Prevention Coaching
Today, the working climate is an important factor for job seekers when selecting an employer. Internal conflicts drive away high achievers and lead to loss of motivation and poor productivity as your employees are distracted from their actual work by conflicts within the company. In the long run, bullying and workplace disputes also increase the number of sick leaves among employees. As a result, conflicts in your organization can be expensive. As the person in charge, you are well advised to resolve conflicts with and within the workforce at an early stage and to promote a sustainably positive working atmosphere.
People have different opinions by nature. Therefore, private as well as professional conflicts are part of everyday life. Truly important is the way you and your employees, colleagues and fellow human beings deal with conflicts. The communication with each other plays an essential role. The goal must be, that everyday conflict situations do not create lasting conflicts that tie up the work capacity and resources.
Smoldering conflicts can turn into a wildfire within the company
In the context of conflict management coaching, I help you address and resolve acute conflicts in your organization. These conflicts are often complex and can smolder below the surface for a long time. Internal conflicts often occur between the following parties:
- Management and workforce
- Management and employee representatives
- Individual employees or entire teams among each other
In order to resolve current conflicts, I work with the parties as a neutral moderator to develop the necessary solutions. Conflict partners are encouraged to openly address the causes of the conflict in a joint dialogue. They then develop a pragmatic solution approach to their conflict together. When resolving conflicts, it is important that all parties concerned are sensitized to the interests and positions of all involved. This strengthens consideration for one another and all involved can present their point of views and contribute to mutual understanding.
In a further step, I look at the current communication processes, interfaces as well as the feedback and debate culture together with you. The aim is to improve in-house communication, which strengthens mutual understanding and enables early resolution of conflicts. Optionally, we can develop a joint agreement which regulates future behaviour among the parties.
Conflict Prevention Coaching
Strategies for timely conflict resolution
In conflict prevention coaching, I work either with you through one on one coaching sessions or together with your team, to develop the right strategies for conflict resolution. Among the important topics to focus on is one’s own communication style as well as the communication within the team – also considering emotionality, body language and rhetoric. This includes fundamental approaches to the perception of others and oneself.
In addition, you will acquire strategies for dealing more efficiently with conflicts or for avoiding them from the get-go. The team structure as well as the group and role dynamics within a team are also relevant.
As a rule, a coaching of the whole team will be structured as a workshop that can take place in your organization or at an external venue. If you follow the jointly developed strategies, you and your team will have optimized communication habits in the future, so that many conflicts won’t even arise. In addition, you will recognize in-house conflicts at an early stage and will be prepared for the solution-oriented handling of conflict situations.
